Don't take on your Lender without a Lawyer!

In Florida, the foreclosure process begins with the lender filing a complaint in Circuit Court. You are then served with a summons and a copy of the complaint. At this point you have 20 days to file an answer with the Court. You can file the answer without an attorney (pro se). However, you might not know the proper legal defenses and counterclaims to file. If you fail to respond in time, the Clerk of the Court will issue a default against you, which prevents you from disputing the foreclosure and expedites the foreclosure process. Once an ineffective answer is filed or a default is entered, it may be only a matter of two to three months until a foreclosure sale is held and you lose your home.

The judge will not give you legal advice. Nor will the judge protect your rights unless you file proper pleadings; perform discovery to find out what documents and witnesses may be of benefit to your case; and properly raise the legal issues that may be troublesome to your lender.
